Non-Representation Legal Form Services Agreement
 
1) Offer and Eligibility
 
Promotion

From time to time, the Law Office may advertise a Promotion for one (1) free Simple Will. To request a free Simple Will during an active Promotion, you must respond using the promotion keyword and communication channel specified in the Promotion (for example: SMS, email, direct message, or web form).

The Law Office may limit the Promotion by time, geography, eligibility criteria, or quantity, and may modify, pause, or end the Promotion at any time, with or without notice.

Eligibility

By requesting the Promotion, you (the “Client”) represent and affirm that:

  • You are at least 18 years old;

  • You are of sound mind and understand the nature and effect of a will;

  • You are acting voluntarily and without undue influence; and

  • You understand Florida’s will execution requirements, including Florida Statute § 732.502.

2) Scope of Service — Scrivener Services Only; No Legal Representation
 
Neutral Scrivener Services Only

Under the Promotion, the Law Office’s role is limited to scrivener/legal form preparation services: transcribing the Client’s provided information into a basic Simple Will that matches the definition in Section 3 below.

No legal advice is provided under the Promotion. The Law Office does not:

  • evaluate your legal needs,

  • recommend planning options,

  • interpret how Florida law applies to your situation, or

  • provide legal opinions.

No Attorney–Client Relationship

Participation in the Promotion does not create an attorney–client relationship. An attorney–client relationship is formed only if and when a separate written engagement agreement is signed by both the Client and the Law Office for paid legal services.

Out-of-Scope Services

Any estate planning advice, customized drafting, probate advice, or representation is outside this Promotion and requires a separate signed engagement agreement and payment of fees.

3) Definition of “Simple Will” Under This Offer
 

A “Simple Will” under this Promotion includes only the following:

Distribution Mechanics (Residuary Only)
  • One (1) primary beneficiary receives 100% of the residuary estate, outright and free of trust; and

  • One (1) alternate beneficiary receives 100% if the primary beneficiary does not survive the testator.

Express Exclusions (Not Included)

A “Simple Will” under this Promotion does not include any of the following:

  • Personal Representative / Executor designation

  • Specific gifts or bequests

  • Multiple beneficiaries or fractional shares

  • Per stirpes / per capita / class gifts

  • Any testamentary trust (including special needs or spendthrift provisions)

  • Guardianship provisions

  • Charitable gifts

  • Pet trusts or pet provisions

  • Digital asset instructions

  • Funeral or burial instructions

  • Tax planning clauses

  • Homestead carve-outs or special homestead provisions

  • Business succession provisions

  • Foreign property provisions

  • Electronic will arrangements

  • Any other customized drafting, special clauses, or non-standard provisions

Florida Rights That May Override a Will

The Client acknowledges that certain Florida laws may override will provisions, including (without limitation) Florida homestead restrictions and the surviving spouse elective share. See, for example, Fla. Stat. § 732.4015 (homestead devise limitations) and Fla. Stat. §§ 732.201–732.2065 (elective share).

4) Requests Beyond “Simple” — Triage, Quotes, and Attorney Consultation
 
Firm Discretion

If the Client requests terms beyond the definition in Section 3, the Law Office will determine, in its sole discretion, whether the request remains within the “Simple Will” scope.

Quotes and Paid Services

If the request is not within the “Simple Will” scope, the Law Office may:

  • provide a written fee quote for additional drafting, and/or

  • offer to schedule a paid attorney consultation.

No fees are incurred unless the Client accepts a written quote or enters into a separate engagement agreement.

Intake Communications (No Legal Advice)

The Law Office’s staff may contact the Client to gather or clarify factual information needed to populate the form. Staff communications are administrative only and do not include legal advice. If legal advice is requested or appears necessary, the Law Office may offer an attorney consultation as described above.

5) Execution, Self-Proving, and Client Responsibility
 
Client Responsible for Proper Signing

The Law Office will provide general written instructions regarding execution. The Client is solely responsible for:

  • arranging proper signing and witnessing,

  • using a notary if desired, and

  • safeguarding the original signed document.

Florida generally requires a will to be in writing, signed by the testator, and executed in the presence of two (2) attesting witnesses who sign in the presence of the testator and each other. See Fla. Stat. § 732.502. To make the will “self-proved,” the Client may choose to sign a self-proving affidavit before a notary in compliance with Fla. Stat. § 732.503.

No Witnesses / No Notary Services Included

Under the Promotion, the Law Office does not provide witnesses or notarial services.

6) Important Legal Effects and Limitations
 
Homestead and Spousal Rights

Florida homestead restrictions and spousal rights may override will terms. The Client should seek legal advice if these issues may apply.

No Tax, Medicaid, or Asset Protection Advice

This Promotion does not provide advice regarding:

  • taxes,

  • creditor issues,

  • asset protection, or

  • Medicaid or long-term care planning.

7) Client Duties
 
Accurate Information

The Client must provide accurate information, including:

  • full legal names of the primary and alternate beneficiaries, and

  • each beneficiary’s relationship to the Client.

Review and Corrections

The Client must review the draft for accuracy (names, relationships, and distribution). One (1) round of clerical corrections is included. Substantive changes or out-of-scope requests may require a fee under Section 4.

Execution and Storage

The Client must properly execute and safely store the original will. The Law Office is not responsible for storing original wills under the Promotion.

8) Deliverables and Records
 
Delivery Format

The Law Office will deliver the final Simple Will in PDF format for printing and signature.

9) Communications and Privacy
 
Consent to Contact

By responding with the Promotion keyword, the Client consents to be contacted via SMS/text, email, and/or phone regarding intake, onboarding, and status updates.

Text Message Consent

The Client expressly consents to receive text messages from Valentino Law PLLC at the mobile number provided. Messages may include reminders, updates, and occasional marketing or educational content related to probate, estate planning, or other legal services.

  • Message frequency may vary.

  • Message and data rates may apply.

  • You may opt out at any time by replying STOP.

  • You may reply HELP for additional information.

  • Consent to receive text messages is not required as a condition of representation or legal services.

  • Consent remains in effect unless and until revoked by replying STOP or by written notice.

10) General Terms
 
No Conflict Check / Limited Confidentiality

Until a separate engagement agreement is signed, the Law Office provides scrivener services only. A formal conflict check and full duties of counsel apply only after a signed engagement for paid representation. Information submitted during intake will be used for processing the request and internal screening; however, the protections of an attorney–client relationship do not apply unless a separate engagement is formed.

Governing Law

These Terms & Conditions are governed by the laws of the State of Florida.

Entire Agreement

These Terms & Conditions represent the entire agreement for the Promotion and may be modified only in writing by the Law Office.

Severability

If any provision is held unenforceable, the remaining provisions will remain in full force and effect.

Acceptance

By requesting or using the Promotion, the Client acknowledges that they have read, understand, and agree to these Terms & Conditions for non-representation scrivener/legal form services.
